Frequently Asked Questions
What is a Trademark?
A trademark is a word, phrase, symbol, design, or combination thereof that identifies and distinguishes the source of the goods of one party from those of others. Trademarks can be registered with a government trademark office to provide legal protection for the trademark owner.
Do I Need to Register My Trademark in Every Country?
No, you do not need to register your trademark in every country. Trademark rights are territorial, meaning that they are only valid in the countries where they are registered. However, if you plan to sell your goods or services in multiple countries, it is a good idea to register your trademark in those countries to protect your trademark rights.
Trademark Regulation in Indonesia
Trademark regulation in Indonesia is governed by the Law on Trademarks and Geographical Indications (Law No. 20 of 2016). The Direktorat Jenderal Kekayaan Intelektual (DJKI) (or Directorate General of Intellectual Property / DGIP in English) of the Ministry of Law and Human Rights is responsible for administering the trademark registration system in Indonesia.
How Long is a Trademark Valid in Indonesia?
A trademark registration in Indonesia is valid for 10 years and can be renewed for additional 10-year periods indefinitely.
How do I Check if a Trademark has Expired?
You can check if a trademark has expired by searching the DGIP’s trademark database. The database can be searched by trademark name, registration number, or class of goods or services.
Indonesian Trademark Registration Process
The trademark registration process in Indonesia can be summarized as follows:
File a trademark application with the DGIP. The submission should contain the subsequent details:
- The trademark
- The goods or services for which the trademark will be used
- The applicant’s name and address
- Pay the trademark registration fee. The fee varies depending on the number of classes of goods or services for which the trademark is registered.
- The DGIP will examine the trademark application. If the application meets all of the requirements, the DGIP will publish the trademark in the Trademark Gazette.
- During the publication period, third parties may file oppositions to the trademark registration. If an opposition is filed, the DGIP will conduct a hearing and decide whether to register the trademark.
- If no oppositions are filed, or if the oppositions are unsuccessful, the DGIP will register the trademark and issue a trademark registration certificate.
